On September 17, 2025, EPPC scholar Rachel N. Morrison submitted a public comment to the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) supporting three proposed rules that would rescind and modify regulations related to federal contractors’ nondiscrimination obligations.
The regulations OFCCP is proposing to rescind require affirmative action and are based on a now-rescinded executive order. As Morrison explained in her comment, rescinding the regulations complies with federal civil rights laws, follows Supreme Court precedent, and aligns with President Trump’s executive orders. Even without the regulations, contractors are still required to comply with the full scope of federal civil rights laws.
Morrison also urged OFCCP to consider protections for religious contractors.
